Governor Arnold Schwarzenegger signed CAI's Senate Bill 1511 into law; it becomes effective on January 1, 2009

Commonly known as the Association Solvency Act, SB 1511 (Ducheny) enables community associations to immediately assess "successors-in-interest" on units that were foreclosed upon. Heretofore, associations may not know whom to assess for up to one year after a foreclosure, depriving them of millions of dollars statewide. CAI's Legislative Action Committee worked exceptionally hard on this measure, conferring with ten other lobbying organizations as the bill moved along. We were the vanguard all the way on this issue. This measure was the only bill specifically dealing with the current foreclosure crisis in HOAs.

Mortgage lenders must contact California home borrowers to discuss loan modifications by phone or in person before entering foreclosure proceedings under a new law Gov. Arnold Schwarzenegger signed Tuesday, July 8. Senate Bill 1137, which takes effect immediately, prohibits lenders from filing a default notice until 30 days after contacting a borrower or making legitimate attempts to do so. The law by Senate President Pro Tem Don Perata, D-Oakland, also requires that tenants receive 60 days' written notice to vacate a property once it is foreclosed.
